| With the reform of the rural economic system, the living standard of farmers has been significantly improved since reform and opening up. However the support level of the Five Guaranteed has not been improved because of the following two reasons. Firstly, the village collective economy collapsed and its function of social security decayed. Secondly, governments at all levels have not placed enough emphasis on the Five Guaranteed, and the measures taken are not adequate. So the living standard gap between the local ordinary people and the Five Guaranteed become greater and greater. More than 90% of the total number of Five Guaranteed has become the poorest groups in rural areas. Regulations on the Work of the rural areas dependent Five promulgated by The State Council and Interim Measures for the Administration of rural homes for the elderly promulgated by Ministry of Civil Affairs have made a great improvement. The party and the government have input lots of human, financial and material resources, but their living conditions are still bad. For example, their house may be in a dilapidated state or they have no money to heal their sick family members and they can feel lonely and neglected. This situation prevails in the country, especially in the economically undeveloped areas. In this thesis, I took the Five Guaranteeds' legal rights to protection as the main substance to discover some existing problems in protection of legal rights by questionnaires and interviews. I mainly investigated the following five rights: the right to subsistence, property rights, the right to health, medical security, the right of access to relief. I want to find out their status quo in relation to the more developed areas and find the existing problems in their day to day life. According to the problems found, I will analyze the reasons and finally put forward specific and constructive solutions.
