Analysis And Comparison On The Act Of Government Procurement Between China And USA

Since 2001, as China's accession to the WTO, China has been driving away at the world standards in various fields. Chinese government had also submitted the application of accession to GPA " (Government Procurement Agreement) and the list of preliminary bids to the WTO Secretariat in December 28, 2007. The first meeting between China and other GPA members was also hold in Geneva to conduct the first round of talks about the bid list and China's treatment. The field of government procurement also becomes the focus of academic affairs. In 2003, with promulgation of "People's Republic of China Government Procurement Law", China's government procurement system is tending to the legislation, standardization and international integration. However, As the result of some different views existed in the frame of GPA and special considerations based on the concrete condition of our country, some items of the action, which are not consistent with the process adopted by major countries, need to be modified and perfected. Nowadays looking at the national government procurement all over the world, the United States clearly has the most perfect system, such as the policy promulgation, departments settings, the relevant legal framework, as well as the regulatory system. Thus, study of US's experience is very beneficial for improving China's government procurement system. The purpose of the paper is to acquiring the experience, identifying the gaps and trying to propose some constructive advice which would perfect our country's GPA through the comparison on the GPA between US and China from management pattern and operation aspect.There are four parts of this paper.The topic of the first part is a simple introduction about Government Procurement Act(GPA).In the part, the features and some basic concepts of government procurement has been preposed at the beginning, then the part continues to tell the difference between government procurement and individual acquisition , finally the history of evolution and legal system on the government procurement act between China and USA are illustrated.The second part does some analysis and comparison on the GPA between US and our country mainly. A large quantities of comparison has been done on the GPA between US and China from management pattern and operation aspect to give the distinction of them in this part.In the third part, some issues on the GPA of China has been revealed. Through studying and analysis in the two parts above, some issues which have been existed in the process of government acquisition have been found. For instance, the application range of GPA in our country is so narrow , the procurement guidelines and monitoring system still should be improved .Finally, some experience which may be benefit to evolution of China's GPA from US has been proposed. The part, based on the previous three parts, provides some advice which has been obtained from the USA's GPA such as enlarging the application range of GPA in our country, perfecting the monitoring guidelines, standarding the procurement process and so on.
