| In China, according to the criminal law and the practical judicature, running a blockade refers to various kinds of illegal immigration and emigration. Accurately speaking, running a blockade, one of the international illegal migrations, is the most bloody, the most unique, the most radical and the most harmful. On the background of globalization, running a blockade has had a negative effect on nations in the world and thereby has become a tough centurial problem. Therefore, study on the problem is tremendously significant with regards to both the theory and the reality. Governments of nations all over the world have already carried out their respective legal actions. China, a developing country that has the largest population in the world, is confronted with such a severe challenge as quite a number of citizens attempting to steal out of the country. To adapt to the situation, the concerned domestic laws require improving.The thesis is composed of four parts. Part one is concerning the general introduction of running a blockade. In this part, running a blockade is accurately defined and told from other related concepts. Besides, part one introduces the current situation, features and causes of running a blockade in China. Part two is about the general theories of the legal control over running a blockade. This part theoretically analyzes the necessity, the balance and ways of running a blockade. Part three aims to analyze the present situation and drawbacks. This part introduces the legal control over running a blockade in China and comprehensively analyzes the criminal system of running a blockade and the shortcomings of law enforcement. Part four is desired to comment on how to better the legal control over running a blockade, regarding the legislation and the system and the measures of law enforcement. Finally, a conclusion is drawn. |
