Study On The Domestic Law Control Of Illegal Migration In China

Entering the 21 st century,with the acceleration of world economic integration and globalization,illegal immigration activities are becoming more and more intense all over the world.As a traditional country of illegal immigration,with the rapid development of economy and society,China has gradually changed from an illegal immigration importing country to an illegal immigration importing country.The problem that foreigners enter the country illegally,stay illegally and find jobs illegally is becoming increasingly prominent,which has a huge impact on China's opening up and social stability.Practice has proved that cracking down on illegal immigration activities is fundamentally a matter of legal control.Only by perfecting the legal system,perfecting legal content and improving law enforcement measures can we truly build a "firewall" to prevent and control illegal immigration.As far as the effect of legal control is concerned,the control of domestic law is pertinent,flexible and easy to adjust.It is also a common control method adopted by all countries in the world.Therefore,this paper will only analyze and study the control of illegal immigration in domestic law,not involving the content of international law control.Our study on the illegal immigrant domestic control started late relatively and still in the stage of exploration improvement,compared to the United States,Japan,the EU and the developed countries and regions,there are many shortcomings.This article begins with the definition of the concept about illegal immigrants,analyzing reasons and harm of illegal immigration,untangling the status of foreigners in China,focusing on the situation and problems of illegal immigration control,coming up with the appropriate countermeasures.The author argues that the domestic law of illegal immigration control is a systemic issue,we should base ourselves on the legislation,law enforcement,and other fields,and comprehensively improve and strengthen it.To unify legislation,establish a consistent with our country's immigration law gradually,to clarify management mechanisms of illegal migration,to refine measures to strengthen the supporting system-building,to strengthen the building of hardware and software,to improve external and internal control system and coordination capacity overall.
