The Study Of Copyright Of Video-sharing Network Station

The internetwork of china has changed a lot in a few years. People who always use internetwork can see the tendency of development of video-sharing network station through the increasing of china's internetwork users. The emergence of the copyright is based on the development of society's economic art and science. In modern society, the scope of copy right will include the information right. The new technology involution which is character by the computer internetwork and communication revolution will make human society to the informational era. The information will be the most important resource for economic technology and society's development and the indispensable. The developing video-sharing network station which develops fast becomes a new platform of information transmitting. The study on the copyright of video-sharing network station will give us a new way to study copyright and intellectual property in order to give a good pact on the legislation of intellectual.This thesis includes six parts. The second part analyses the legal duty of the user of the internetwork video according the five actions which are uploading transmitting internetwork editing inner network using and distance learning. The third part analyses the legal duty of the customer of the video-sharing network station according the three actions which are downloading browsing and cache. Especially give more attention to the cache which is the new technology. The fourth part analyses the legal duty of the provider of the video-sharing network station serving according the two parts. In the situation of direct infringement, the author analyses the Proxy cache and Transmission channel. In the situation of customer infringement, the provider of the video-sharing network station serving should stop infringing compensate and apologize. The fifth part analyses the restriction of internetwork copyright which includes rational using official licensing and compulsory licensing and give some advises. The last part the author provides some methods which are private protection and administrative protection to protect the copyright. The personal protection includes seven ways and the legal protection includes Collective management system and warning-deleting system. Then give the copyright compensating system based on the analyzing on the feasibility and necessary of our country.In order to perfect our legislation of china's intellectual property, the author give some advises though analyzing the key question of the copyright of the video-sharing network station. Although I am lack of the ability and experience, I try my best to give some useful attempt to study intellectual property.
