Thoughts On Movable On Establishment Of A Unified Security System In China

The security interest system is not only the basic means to safeguard market transaction's security, but also the effective method for regulating on socio-economic. Mr. Wang Zejian think: "In respect of the comparative law, we would notice that the more developing the market economy of the country is, the more advanced the country's security system is. "For our country's market economy is in its infancy, the depth and breadth of market transaction should be further enlarged. Furthermore, transaction as the center should be the goal of China's economic reforms .And then; security system should develop continuous and have the new rules to adapt the new tendency. On October 1st, 2007, "Property Law of the People's Republic of China" was officially implemented . Compared with the Security Law and its judicial interpretation, the Property Law has many new provisions on security interest. But, we should have realized that the period of cheering for the successful publication of the Property Law is over. At present, many rules should be further studied, as well as, in the Property Law; the provisions of security interest for movable property still have to be improved. In this thesis, the author wants to make an introduction on the development, the evolution and the function of security interest for movable property. We focus on analyzing the imperfectness existed in china's movable property. Meanwhile, combined with other countries' successful experiences and our country's reality, we would like to propose some advices on the construction of a unified security system for movable property in China.
