Abstract/Summary:
This thesis argues that models to increase confidence in intellectual property transactions may be developed by more closely integrating considerations in law and finance. It demonstrates how, applying influences from network theory, distributed systems, and other forms of property, greater confidence can come from an approach that is bottom-up, introducing standardized considerations at the level of the individual piece of intellectual property. New models are presented for (1) a motility factor in the valuation of intellectual property, (2) a taxonomy for intellectual property assets, (3) a distributed certification system for verification of intellectual property status, and (4) a protocol for the creation of a security interest using intellectual property as the principal financial asset.; Examination of the IP-backed security interest is a useful proxy to increase clarity in the wider field of IP transactions, since the security interest is, in essence, a transaction-in-waiting (Emphasis on the relationship between verification and value is meant to inform other topical areas such as access to capital in the knowledge industries and the commercialization of intellectual property, as well as contributing to future insights at this new intersection of law and finance.
