On The Legalization Of The Open And Transparent Operation Of The Administrative Power Mechanism

Starting to implement the open and transparent operation mechanism of the administrative power in 2005, Handan city, Hebei province has made great achievements in all aspects such as the reform of the system and the innovation of the mechanism after 3 years'research and exploration. The reform is successful in that an operation pattern of the administrative power suitable for socialist market economy has been gradually set up in practice.Through the introduction and analysis of the practice of implementing the open and transparent operation mechanism of the administrative power by Handan city, this thesis explores the theoretical basis of the mechanism, briefly elaborates the development and transformation of the operation mechanism of the administrative power of our country as well as the features in the process and points out the existent problems in the operation mechanism of the power in our country.In the last half part of the thesis, having analyzed the influences of this mechanism reform on the development of the administrative law system, the transformation of the government functions and the building of the government by law, this thesis holds that the open and transparent operation mechanism of the administrative power must be legalized to rectify the problems in the operation of the administrative power in our country in the context of building a socialist country by law.Finally, the objectives and principles for the legalization of the open and transparent operation mechanism of the administrative power are put forward. According to the situation of the development of the administrative law system in our country, some proposals of measures and practices are made in the administrative organization law system, the administrative procedure law system, the supervision administrative law system and the administrative accountability system.
