The Study On The Legislation Of Minimum Living Standard Guarantee System For China's Farmers

The rural population of our country accounts for the majority of the total. The Three Rural Issue of Agriculture has always been a most important restriction factor of our country's development. The key to solve the problem lies in the farmers, while the issues of the poverty-stricken population are the most pressing, difficult and the most likely to trigger social conflict of all. Our country is a large agriculture nation with a large rural population base as well as a large amount of the poverty-stricken population. Since 1986, the Party and the government have spent a lot of money, human and material resources, adopted various kinds of measures in the work of anti-poverty for the rural areas, which has got a remarkable achievement. After 2003, despite the great effort we've made in anti-poverty work and the increase of both manpower and material, the poverty doesn't seem to be alleviated much. The poverty-stricken population has not seen a large scale reduction, eventually the traditional poverty relief means have come to an end, can not play an effective role in the process of anti-poverty any longer. According to the international experience, some experts said that our country's poverty-stricken population should establish the minimum living standard guarantee system which imitates the urban areas, adopt a "transfusion" and "blood" combined approach, relying on the power of government and society to make this part of the poorest rural residents live. This article examined carefully about the history and presence of the legislation for the minimum living standard system at home and aboard, and discussed the basic theories as well as the problems in the process, it also suggested on how to establish a sound system for the rural population. Besides the conclusions, the article consists of five parts, the first section is the introduction; we outlined the minimum living standard guarantee system in the second part and gave a comparison next to it. The fourth section talked about some macro problems of legislation and the fifth one stated the micro sides.The first section gave a brief introduction on research backgrounds, literature review and research methods. We think establishing the minimum living standard guarantee system and solving the living problems of the poorest ones in rural areas, are the keys to The Three Rural Issue of Agriculture. It is a must to keep the stability in rural areas and fasten their development speeds. The legislation also has a lasting significance in promoting the scientific development concept and building a harmonious society. We used the comparative analysis, historical analysis and logical analysis in the whole article.The second section introduced the concepts and features of the minimum living standard guarantee system as well as other relative concepts, leading the readers to a brief realization of the study. It also briefly talked about the necessities and possibilities of the legislation, explained the purpose and significance.The third section gave a explanation of the legislation for the minimum living standard guarantee system, compared two different histories and current situations at home and aboard, providing some useful experience for our legislation in the future.The fourth section analyzed some macro-issues in the legislation, including more complex issues such as basic principles of minimum-living legislation, establishment of standards, procedures of identifying people to be included, allocation and supervision of the minimum-living fund, legal responsibilities. While the fifth section analyzed some micro-issues, including the principles, he process of the legislation and other complex points. In the two parts, we provided our own ideas.In the conclusion section, the author states the highlights and shortcomings of the article and the future of the legislation for the minimum living standard guarantee system in rural areas. Meanwhile, we expressed our determinations in the last words, that is, to make a remitting effort to resolve the legal issues.
