The Research About Procedure Of Marine Enforcement

In the framework of globalization, the exploitation and utilization of marine resources has become a breakthrough of national economic development since this century. Hence, the marine enforcement stretches into following fields, such as the protection of marine rights and interests, the preservation of marine safety, the exploitation and utilization of marine resources and the protection of marine environment. Currently, there are still many gaps in related regulations in China, especially in the provisions of marine enforcement procedures. It exists a couple of marine enforcement administrations, the procedures have not yet adopted a unified and specified standards. Lack of procedural rules of special items is also a problem.The thesis addresses the issues of procedures of marine enforcements in four parts by using the method of researching the combinations of theory and practice and the principles of administrative law. Part1, firstly, the author introduces the overview of the procedures of marine enforcement. Secondly, the thesis analyses the procedures of marine enforcement and classifies it into two types as general procedures and specific procedures. Part2, the author discusses the general procedures and the specific procedures of marine environment management, cruise on the sea, life rescue at sea and boarding and hot pursuit. Part3, the thesis analyses the situation of the legislation of procedures of marine enforcement. It is concluded that there exist many problems of the law and what the problems exactly are. Part4, according to the research of the problems in law, the author comes up with the proposal of perfecting the procedures of marine enforcements. On one hand, we should build the system of procedures of marine enforcements. On the other hand, there should be legislations of specific procedures in laws of marine enforcements.
