The Study On The Chuming System In Sui And Tang Dynasties

"Churning System" is an additional penalty existing in the law system of all dynasties, which means "removing the position,the title of nobility and the diploma ". It is applied for punishing culpable officials.This paper includes three parts.(1) Chuming System in the dynasty of Sui.This chapter is composed of four parts:First,History of Churning System. Second,in the Dynasty of Sui, Churning System existed all the same; furthermore, it functioned as an important way of punishing the officials including violation of imperial power, destruction of regime abuse of position, military crime and implication. Third, analysis of characteristics. From the analysis of the previous parts, we can get the following characteristics:the application of Churning System is of great frequency in the dynasty of Sui; the officials involved are mostly those of high position. Four, the influence,Chuming System has influenced a lot in the fields of politics and military.(2) Churning System in "Tang Code" and the cases in the Tang Dynasty.This chapter consists of two parts:First, Churning System in Tang Code, which is the earliest and most complete legal code and also the most typical one. In this code, the clear and concrete definition of Churning System is found. Second, cases in the Tang Dynasty. At this dynasty, the Churning System is also frequently used in the existing information, there are the cases of application by law and those not by the law.(3) The characteristics and functions of Churning system in the Tang Dynasty. First,characteristics analysis including three aspects:high ranking of the officials, severity of applicable charges, and arbitrary of the penalty.Second,the effects which is expressed in the political and military.Third,in the late of Tang dynasty, the laws changed a lot with the development of the society,also the Churning System is in this changing range.The influence of Churning System to the following days. Obviously the influence is huge. In the following dynasties of Song, Yuan, Ming and Qing, there exists the punishment which resembles Churning Systemin the system of laws.
