Research On The Anti-monopoly Law Enforcement Agencies In China

To protect free and fair competition order,anti-monopoly law is one of the basic laws to modern market economy,and its essential function operates efficiently is depending on the law enforcement agencies.As "People's Republic of China Anti-Monopoly Law" has just been implemented, anti-monopoly law enforcement agencies still have many shortcomings.Therefore, explore how to establish anti-monopoly law enforcement agencies and set of its responsibilities reasonably are of great significance.Author analysis and study anti-monopoly law enforcement agencies abroad,then analysis and estimate the situation of China,give out some useful suggestions.This paper is divided into four chapters, the first chapter is "China's current anti-monopoly law enforcement agencies and their problems". This chapter introduces the composition,responsibilities and power of China's current anti-monopoly law enforcement agencies,study the relarionship between anti-monopoly law enforcement agencies and industry regulators, and pointed out the problems of China's anti-monopoly law enforcement agencies.The second chapter is "the advice of China's anti-monopoly law enforcement agencies and its evaluation".The third chapter is "foreign anti-monopoly law enforcement agencies". By the research of United States,Germany, France, Japan's anti-monopoly law enforcement agencies,We can understand the nature and the responsibilities of the anti-monopoly law enforcement agencies, and summed up its characteristics and trends.The fourth chapter is "the thought of the enforcement agencies of China in the future". First of all, we should fully think of the specific situation of China and the trend of world enforcement agencies before we establish our own enforcement agencies.Secondly,we should follow some principles when we found the anti-monopoly law enforcement agencies.Thirdly, author thinks that there should be a special enforcement agency of antimonopoly law,being charged by the head of it,which has been existed in the past.For the seek of author and independence of the agency,author thinks that such an agency should be leaded directly by the Council,and its independence should not be influenced often;as for the specific organization,there should be more functional departments,so as they can work together efficiently. What's more,the quality and quanlitity of the members of the agency should also be emphasized.As for the function and legislation of the special agency,the new anti-monopoly law should stipulate definitely. What's more,the newly established agency should be given more comprehensive powers,so as it can enforce the law effectively.
