The Legal Issues Of Transfer Of Contracted Land Manegement Rights

In recent years, the transfer of the right to contracted land manegement is rising in vast rural areas, it is the further development of market economy in the reform of rural land contract system. It is not only conducive to the effective allocation of land resources in rural areas, but also to prevent land barren, so it is another original act in rural areas. the transfer of rural land is not devised by jurists, therefore,legal factors is not considered in its development.There is important theoretical value and practical significance to study the legal issues in the transfer of the right to rural land. Apart from the introduction and conlusion, this paper mainly includes three parts.Chapter one:from the concept of rural land transfer talking, it mainly describes the principles,types,causes and legal characteristics of rural land transfer, with an emphasis on the current academic debate on the transfer of land.Chapter two:It sorts out a evolution of policies and law on the transfer of land since the founding of our country, and has a classification based on time.According to the legislative and ptactice, it analyzes the cause of the defects in legisative design.Chapter three:From macro-law of governments, self-improvement of land laws and supporting measures of rural land transfer talking, it elaborates on approaches of legal protection of rural land transfer. The goverments macro-law and self-improvement of land laws are the point of this paper. Finally, it lists the complementary measures to improve the legal system of the transfer of the right to the con tractual manegement of rural land,namely:reform household registration system, improve the social security system in rural areas and perform a scientific role orientation of the government,the village collective and the contractors.
