The ASEAN Charter And The Construction Of ASEAN Community

On November 20,2007, the 13th ASEAN Summit signed The ASEAN Charter, and the Charter had entered into force at the ASEAN Foreign Ministers meeting which held in Jakarta on December 15,2008. The Charter established the ASEAN's development goals, principles, status, framework, and other related contents, had officially given the legal personality of international law to ASEAN, and intended to promote ASEAN from a loose regional organization to the institutional community which will be guided under The ASEAN Charter not only in thought but in practice. The birth of the Charter marks the long-waited ASEAN community-building finally owned the legal norms and institutional support, and it is an important milestone in the history of the development of ASEAN. In the future it will play a greater role in promoting regional peace, stability, prosperity and development will in Southeast Asia.The ASEAN Charter opens up a new era for ASEAN's regional cooperation and put forward a clear goal to the future development of ASEAN. Furthermore, the Charter had established the purposes and principles to the developing community, and setted the construction of community on a right track. It makes the goal of Southeast Asian community which advocated in The ASEAN Declaration closer. To ASEAN, whether the ASEAN Community to be completed as schedule or not, will depend on the development of ASEAN regionalism which under the guidance of The ASEAN Charter and the the formation of mutual trust among the ASEAN members. This is a difficult task, but the process has started, the regional integration trends will be irreversibly.Accordingly, as a new study field, The ASEAN Charter and the Construction of ASEAN Community has already attracted the attention of domestic and foreign scholars. In this paper, the analysis to The ASEAN Charter is the entry point, the studies on The ASEAN Charter and the Construction of ASEAN Community will be placed in the research framework of Regionalism, by analyzing its intrinsic relationships to explore the establishment of the ASEAN Community, and sparks the profound consideration to the integration of Southeast Asia and the construction of ASEAN Community.Based on what has mentioned above, this paper is composed by five parts. The first part is the Introduction to this paper, is mainly consists of purpose and valuation of the study, achievement and present situation of the study, the framework and the research methodology of this paper, and so on. The second part is to construct the theoretical framework for the whole paper, that is, to deduce the connotation of the regionalism developed in Southeast Asia. The third section focuses on the content of The ASEAN Charter, through the analysis on the birth of the Charter's background and the specific content to explore the instructive value for the ASEAN Community building. Part four is the largest chapter of the paper, is mainly analyzes the APSC, the AEC and the ASCC building in the process of the construction of ASEAN Community, also discusses the dynamics mechanism and influencing factors on the construction of ASEAN Community. And finally in the fifth part the Conclusion sums up the full-text content, and anticipate the future to the regional cooperation in Southeast Asia, especially the process of the construction of ASEAN Community.
