Research On Issues Of Food Safety Law

The "Poisonous Milk Scandal" of China raises great concern for food safety. Meanwhile the Food Safety Law promulgated in 2009 also become a hot topic .Food Hygiene Law has faded from the historical stage,our country has entered a stage of Food Safety Law .Each link will be Standardized by the concept of The Food Safety ,including food production and food processing ect. The adjustment scope of Food Safety also expanded to a whole process, which spread from farm to table .This article will have a research of Food Safety Law in four part.The first part gives a unified description on food safety and Food Safety Law. In the introduction of food safety meaning, food safety is considered under a background of the whole security issue. After understanding the meaning of food safety ,the next issue is the definition of food safety law ,that the position of Food Safety Law in the Legal system .Under the fact that food safety distributes in security field ,Food Safety Law belongs to the category of Security Law. The third part describes the characteristics of food safety law .Risk analysis model has been carefully explained here .The relevance between risk and security is an important theoretical basis for the cite of risk analysis model in Food Safety Law .Further three elements involved in risk analysis, which are risk assessment risk management and risk communication, has become a core issue carrying through the whole Food Safety Law. Based on the relationship of Food Safety Law and Ecology Law, it has become a major feature of our Food Safety Law that to understand food safety with ecology security. The understanding of food safety in the framework of ecology security will promote the realization of food safety in both concept and practical level. The last part introduces the development background and guiding principles of Food safety Law.The second part focuses on the relationship between Cleaner Production Promotion Law Agricultural Product Quality Law, the Product Quality Law, Consumer Protection Law and Food Safety Law. Before the study, the paper first clarifies the meaning of food. There is a critical point in the understanding of the meaning of food, that is how to distinguish the generally accepted food with law prescribed food. In "Food safety Law", food is commercialization production, which is different from self-sufficiency food. Otherwise productors operators and consumers will not associate with Food Safety Law , risk assessment risk management and risk communication will also become meaningless. Four aspects outline the shape of our country's Food Safety Law. They are the origin between Food Safety Law and Clean Production Promotion Law, the promotion of good to the aspect in ensuring food quality of Product Quality Law, the convergence with Agricultural Products Quality Law and several contact complemented by Consumer Protection Law.The third section introduced the food safety law system of United States, Japan and Australia. The USA has made an assorted protection of food safety. Meat, poultry, eggs, food, drinking water and alcohol etc. are standard by "the Federal Food, Drug and Cosmetic Act (FFDCA)", "Federal Meat Inspection Act (FMIA)", "egg products Inspection Act (EPIA) "and other norms. The joint supervision system in food safety field of the USA is also unique. Besides the most unique part of Japan's food safety law system is the "Food Safety Basic Law". To the core of the Act, more than ten laws , including "Food Sanitation Law", has been received a large-scale modification and promotion, which cover the whole process of food supply. In addition all Japan's food safety law systems appear in the form of law, which provide a high effect. The Canadian Food Inspection Agency , which is recognized as the world's best agency, has been highlighted in the part of Canada's food safety system. When introducing the first three food safety law system ,the article also contains a compare between them and us. The shortage emerged in the comparative analysis will greatly promote our country's food safety law system.The four part give a full account of the characteristics of food safety law. Combine with the practice lessons in the legislation of food safety law by other countries then propose related suggestions to our food safety law. The article supposes that our country's food safety law should have a rapid development in the following aspects:"consumer participation in risk communication ";"clear of the responsibility in food safety Committee";" concerned about the animal health and welfare" and "study the problem of food allergy". We hope the series opening conclusion could benefit both theory exploration and legislation practice of our country's food safety law.
