Reflections On The Related Issues Of Food Safety Law In China

Food safety is an important problem which closely related with our life, and ongoing food safety events have made it become a heavy topic which we care about, but we also worry about. But,"Crisis is also an opportunity," food safety events happened again and again prompted us to constantly improve food safety supervision level, perfect legal system, and finally gave birth to the promulgation of the food safety law.The span of legal reform influences the social change speed, the depth of the law reform affects the effect of social governance, and the specific environment of economy,society etc will also affect the implementation of law. We have got significant progress in our food safety level and food safety supervision level since food safety law issued, but we still face some challenges.This thesis tries to give a brief analysis of the challenges faced by the implementation of food safety law. These challenges include:challenges of legislative lag; challenges from food safety regulation, such as multi-sectoral food safety regulatory system will inconsistent with the single sectoral regulatory system after the institutional reform, the imperfect of food monitoring network and risk early warning system, low perform error of punitive damages, the problem of of food safety accident report system; lack of food traceability system and the predicament of the "recall" system implementation; the influence of the food safety standard conditions to achieving the effects of the legislative purpose of food safety law, etc., and think about the corresponding countermeasures.At present, our country’s food safety supervision work has made great progress, we have not only made a science, advanced food safety law, but also established a unified, authoritative and efficient single food safety regulatory system, which will provide an important legal and institutional guarantee for the future food safety supervision work and food safety level improve. Although, there are still some risks in our current food security situation and our food safety regulatory work also faces some challenges, but all of these risks and challenges are preventable, controllable and can cope with. Believe that with the improvement of our regulatory work in the future, our food safety regulation ability and the level of food safety will gain new ascension and progress.
