The Research Of China's Procedural Constitutionalism Development

Process of constitutional study was only recently paid more attention to the issue,the research in this area is still in its infancy,little monograph, content is also a lack of a more systematic discussion of a more comprehensive, integrated system architecture has not been formed. In this paper, the theory of socialism with Chinese characteristics, the guidance, based on the construction of China's national conditions and constitutional realities, and actively absorb foreign constitutional reference of the latest theoretical results, objective analysis procedures for civil law countries, the historical process of constitutional development and useful experience for China process of constitutional development of a preliminary exploration of the road. Article dig through the relevant literature and practical construction of a comprehensive study course, trying to accurately explain the connotation and extension of the constitutional process, explore its theoretical origin, comprehensive and objective grasp of constitutional procedures and problems of development, learning from the civil law Department of Constitutional Government in the national program of advanced concepts and the value of positive results, efforts to find the current process of constitutional development pattern of China and the specific path chosen to study in depth for the constitutional process and the initial establishment of the Theoretical System of a brief try.First, the system put forward the basic theory of constitutional procedure, described in detail several typical civil law countries, the constitutional development process, efforts to achieve a comprehensive and accurate.Second, from a historical perspective, a hundred years of constitutional practice in China has systematically sorted, and summed up the experience and lessons of constitutional development.Finally, analysis of the current lack of procedures for constitutional construction to start, by improving the political construction of the concept of our Constitution and basic ideas, to seek the path of China's program of constitutional construction.
