Social Dumping: From The Perspective Of International Economic Law

Globalization is the trend which can not be ignored. However, impact is also happened. Every country, not only needs to command the opportunity of globalization, but also face to the problem follow with it, especially the economic issue. In the opening trading structure, investment of multinational enterprise, international division of labor and high pitched competition, importance of economic development, capital flow, different in national structure, rising area organization etc are emerged from globalization, but we can not resistant it.Social dumping is controversial and contains wide range. Not only social issue, trading, law, political, and social factor of importer and exporter, but also relate to country policy and economic development. The affection expand to nation to nation, even organization to organization. Hence, social dumping is question which is difficult to be resolved. There is still no standard to prevent, also does not suit to clear up by judgment. Starting with harmonization mechanism to protect each country, or developed countries and undeveloped countries to improve their economic development, aiming at curing different in economic development then enhancing their human right, social responsibility of enterprise, environment and working safety.
