In recent years, with the increasing of the concerns about the human rights in theworld, human rights problem has been the arms which are used to attack China by theWestern developed countries. With the promotion of world trade on a global scale,discussions about human rights issue have expanded from the political sphere to theeconomic sphere. From the prospective whether human rights should be "WTO" articles,this paper argues that the right to work, as one of the basic human rights, will play aneffective role in protecting workers’ rights. On this foundation, it demonstrates therationality of "Social dumping". Scholars who support labor rights believe that this fullyreflects the international justice, while opponents argue that if labor standards arearticles of WTO, it may form new trade barriers.In order to understand the usefulness of social dumping, the paper will study thenature of social dumping by comparing it with the ecological dumping. Now there arearticles about exceptions environmental protection in the WTO provisions, while noarticles about labor rights protection. Both are now hot social issues which areresponses from the forces in the international competition. Considering the difference ofsocial and historical development, the factors which are involved in problems to besolved by social dumping are much more and more complex. At the same time, thepaper hopes to provide some experiences for the future cases about social dumping.In the end, I believe that China should not compromise nor object completely onsocial dumping, that we should establish response measures, participate actively in theWTO negotiations and further improve relevant policies and legislation.
