Study On The Regulation Of Macro-control

In the introduction,the background for the topic,the current research about the topic,the content of the thesis and the methodology are expressed in turn. As a result of the the international financial crisis,the phenomenon that governments take measures to bail the economic out has beome universal around the world.In my opinion,macro-control has both advantages and disadvantages to the market. View macro-control dialectically, reflections on the legitimacy of the macro-control may come into being. The present legal studies has not pay more attention to legitimacy in the legal sense than legitimacy in the social sense.In this thesis, in order to make multi-angle argument, I choose to use multidisciplinary methods.The thesis includs four parts:In the first chapter, in order to make a clear understanding of macro-control,the thesis summarizes the exsiting definitions from both China and overseas,and finally,it makes the definition that macro-control is a service-oriented power.Furthermore,it mades the point that the essence of macro-control mechanism was a functional reinforcement imposed on the Economic Systems by the Political system.In the second chapter,the thesis analyses the dilemma of the legitimacy of the macro-control.Firstly,it defines the connotation of legitimacy,it holds the conception that legitimacy means act according to law and at the same time,the law in itself is with justification.Secondly,the thesis express its views as follows:In regard to the dilemma of the legitimacy of the macro-control, the substance-oriented power operating mechanism is its starting point;How to justify"act according to law"is a problem for macro-control in modern society;and finally, the Institutional Innovation and the information competition are the real incentive for the dilemma.In the third cahpater,the thesis focus on the legitimacy cognition of macro-control in china. In the first,it Interprets macro-control in thecontext of Chinese reality,then makes a conclusion that macro-control faces both Economic crisis and Social crisis.Given the social reality,the cognition of power legitimacy tends to prefer a functionalism path. Finally, in order to coordinate the contradiction between functionalism and normativism,the thesis insist on setting a Institutional framework for this two kind of cognitive pathes,named "Economic Constitutionalism". The fourth chapter,as the core of the thesis,starts to deal with the path to regulate macro-control.In terms of legitimacy,the regulation of macro-control consis of four factors:the cognitive path,the value trends,the operating base and the running mechanism.To ensure the legitimacy of macro-control,we should turn the "recognition"to "consensus",lay more emphasis to the interaction and communication between the people and the government;we should take measures in pursuit of not only Economic Efficiency but also Economic Freedom;we should make Economic Freedom an Inseparable part of Constitution,make it to be fundamental rights; In the final analysis,we should put Economic Constitutionalism into practice.
