Research On The Control Over Macro-economic Regulation By Coordinate Legal Procedure

The purpose of control over macro-economic regulation by legal procedure is to ensure the government's macro-control actions accordant with the requirements of social economy. Therefore, the main content of this thesis is to explore the way and method by which the validity of actual macro control is warranted, to probe the system construction from the angle of regulating the Government's actions and ensuring the legitimacy of the actual macro- control .Firstly, by the study of the correlations among the legitimacy and essence characteristics of actions and the avenue of legal control over them , the author think that the best way by which the validity of actual macro control is warranted is the coordinate legal procedure. The validity of macro control means not abiding to law but also accord to the development of the society and economy. The macro-economic control, in essence, is one kind of law-enforcing act, a government economic function under the guidance of basic spirit of harmony and a kind of power-wielding action. In the meantime, characteristics of macro-control, integrity and mobility that macro-control takes on lead to the deficiency in the course of the regulation of Macro-control substantive law. The particularity that macro control is a government power-wielding act indicates it has to be controlled, while its essence of harmony shows that external force must be always intervened in a negotiable way; The traits of integrity and mobility of macro control also cause that macro-economic control can not keep in conformity with the development of social economy all the time.Secondly, an important particularity of coordinate legal procedure is that it can receive the intervention of the coordinate external force, while compatible with the basic spirit of harmony of macro control. The basic principle of operation of coordinate legal control that it can ensure the validity of actual macro control is those:through the function of its communication and coordination ,and under the coordination, it leads the limiting strength to the field of macro-control. This prevents the government to misuse its power, and it also improves the regulating ability of the government.
