The administrative law forcible execution in one country different with other country in regard to the difference in the law tradition ,authority stand separately and the theory of administrative of one country .however, mainly speaking ,there are judiciary forcible execution, administrative inplement pattern and judical with administraive forcible execution system. The UK-US genealogy of law country emphansize judical implementation pattern. Continent law attach importance to administrative forcible execution .our country"apply for country carrying out under coercion for principle ,take that administrative organ exeption"administrative forcible system.But this system has received a lot of criticize whether in theory or practice. it′s carrying effect is not good ,often occuring administration power and judicaliion power interpenetrating. ,thus not improving administrative effection and not portect relative people′s legisltion interest,finialy landing with each other.It is a big poroblem existing in our current administrative forcible system. The article is analysis our country current administrative system and put it into thought ,then put forward following restructuve thought train:put the auyhority of administrativ to administration organ in orde to make sure the effecint.and establish speclized caarying mechansim in county above, which take charge of administrative enforce ,but the court maintain it′s judgement position. At same time ensure controling and banlant the opertative mechanism of power by perfecting inplemention proceeder and concering supervsion system . so that construct one administrativeforcible system in which administration organ , judical organ assume their respective roles and work smoothly.
