Study On Legal Issues Of Genetically Modified Food

With the development of bio-technology, people's lives have changed largely.Among the bio-technology achievement in the 20th century,the transgenic technology is called"second green revolution".It alleviated the food crisis caused by population explosion and lack of energy.But people pay close attention to the potential risks of transgenic technology from the beginnin of its birth. Each country around the world make bills to supervise and manage the genetically modified food(GMF) .Around the world, USA and EU seperately takes loose policy and strict policy, and Japan represent the compromising party . Although China has reached the advanced level in transgenic technology area around the world,China falls behind in the legislation of supervision of genetically modified food. Therefore, it become the most important work for Chinese law workers that research the legislation of genetically modified food.This paper is divided into four parts. At the begening of the first part ,the paper introduces what is genetically modified foods and the development of the genetically modified crops.On the base of those concept,the paper investigates the potential security problems of the genetically modified foods and the attitudes of the United States, European Union, Japan and developing countries.The secend part introduces the international agreements and some WTO rules that involve with genetically modified foods ,and the specific legal provisions of the United States, European Union and Japan.Pay special attention to the laws and regulations,agencies and specific relevant regulations of those three countries that adopt different model legislations.The third part is the focus of this article.Firstly,the paper discuss that we should adopt a basic attitude that not only positive but also cautious on genetically modified foods.Secendly,the paper introduces the China's current legislation on genetically modified foods from the laws and regulations, agencies and specific relevant regulations and analysis the deficiencies on the legislative level, management system, legislative concepts, labeling system and testing system. Finally,on the base of the necessity and the feasibility,the paper propose some specific countermeasures that on genetically modified foods.The last part summarizes the importance of the genetically modified food legislation that we research. In reference to some genetically modified food management experience of the developed countries,we improve the China's genetically modified food safety supervision gradually.We should develop a specific comprehensive legislation that on genetically modified foods to make the regulation of genetically modified foods develop effectively.
