With the development of transgenic technology, the proportion of Genetically Modified Organisms(GMO) trade in the international business increases year by year. There exist large diversities and conflicts in international multilateral agreements as WTO, CBD(Convention on Biological Diversity) and others on GMO issue due to the different attitude toward to trade liberalization and environment safety. This paper attempts to analyse the diversities and conflicts by reviewing of international multilateral agreements on GMO, and envisage the solutions to resolve problems with the consideration of international trade and judicial practice, also puts forward a proposal about the legislation of GMO on the basis of combinative consideration of international multilateral agreements and China’s laws and regulations.This paper could be divided into five parts except the preface and conclusion.The first part is an introduction on the concept of GMO, Transgenic Technology,GMO Product and the current situation of GMO industry on a global scale, also an discuss about the possible risks of GMO to promote the role of GMO legal regulations. The second part divides international multilateral agreements on GMO into three categories as WTO, CBD and other international organization documents,expounds the legislation of GMO on the lever of international law. The third part analyzes the conflicts between WTO and CBD according to the aspects as their causes, expressions and consequences, aiming to make statement on the conflicts in the application of international multilateral agreements. The fourth part reveals the difficulties in the coordination of international multilateral agreements, propose possible solutions to the conflicts between international multilateral agreements. The fifth part introduces the current status of China’s GMO legislation, combining with the international legal regulation of GMO, putting forward suggestions and countermeasures to China’s legal regulation system.
