Research On The Distinction Between Labor Supervision And Labor Arbitration

The legal system of labor supervision and labor arbitration bears in the historical period between liberal capitalism and monopoly capitalism. With the trend of labor movement, the labor's rights need to be strictly protected by state power. So the legal system of labor supervision was established. But the principle of autonomy of will and freedom of contract still existed, labor disputes can be solved with private law, so the labor arbitration system was also established. However, the legal systems in China are far from perfection, the legal system of labor supervision and labor arbitration has no clear boundary, and those laws are not well- practiced.So this dissertation takes the distinction between labor supervision and labor arbitration as the research object, and put forward some measures as suggestion.
