Study On The Development Of Labor Security Supervision System Of China

As the key component in basic theoretical research of Labor Law and law enforcement practice of labor security supervision department, labor security supervision system is a major means to carry regulation and adjustment of law towards labor relation authorized by law in each modern country. For realizing their own interests to a maximization degree, market actors usually through sacrificing labors'interests to promote the competition of enterprises, this must be bound to violate the requests of laws and administrative regulations. Considering relatively weak position the labor is in labor relation, the country's labor security supervision departments should appear as a managers and supervisor of labor relation to apply laws and regulations to intervene and punish the activities of impairing the labor's interest, for protect the labor's legal interest and promoting the harmonious development of labor relation, this also underlines value pursuit of labor security supervision system.However, as our country's labor security supervision system is not perfect, on legislation, enforcement and team construction sectors, there are many problems. Therefore, we must reconsider our labor security supervision system so as to meet the request for protecting the labor's interest with continuous development of market economy.The first part of this paper mainly tell the basic theory of labor security supervision system, including historical development, definition, legal characteristics, basic functions labor security supervision system and the relationship between labor security supervision system and labor arbitration. The second part mainly analyses the problems of labor security supervision system, harms and formation reasons. The third part mainly introduces foreign labor security supervision systems, through contrasting them with our country's system, thereby gain enlightenment from foreign labor security supervision systems. The fourth part bases on the last part, elaborates the suggestions of perfecting labor security supervision system, including four aspects: system, legislation, supervision and responsibility. This part mainly put forth suggestions for perfecting labor security supervision system against the problems existing in our country.
