| In2008, a series of labor substantive laws and procedural regulations were implemented. This provided specific and clear guidance laws for labor arbitration practice. Labor dispatch case is very special kind of the labor arbitration practice. Labor dispatch case has obvious different from general labor dispute case. The legal relationship of labor dispatch contains three main body. They are laborers、dispatch unit and employment unit. Employment and use are different. The research of these questions of labor dispatch is valuable.This paper begins with a case. The author analysed the questions of labor dispatch firstly, and then gave modification advice.The paper is composed of four chapters:Chapter one, two and three:This part is mainly researched three questions aforementioned. About jurisdiction of labor arbitration, researched the unauthorized jurisdiction. About common party of labor arbitration, researched the joint of enforcement party. About joint responsibility for compensation of labor arbitration, researched the necessity of joint responsibility. Finally, analysed the influence for labor arbitration.Fourth chapter:Provided solutions to the problems aforementioned. Problems about jurisdiction, suggest modify relevant laws, establish and improve the Jurisdiction regulations. About the common problems, when the request for arbitration is about personal characteristic, sending unit and the unit that use worker are not general party. About joint responsibility for compensation problems, for legal obligation, sending unit and the unit that use worker do not assume joint responsibility for compensation; obligations agreed upon, they shall be jointly and severally liable. |
