Administrative Protection For Personal Information

Being the valuable resource, personal information could provide the evidence for the government decision and also could be used commercially. But at the same time, Cases of personal information infringement become more and more and personal information is facing up to the severe threat. Therefore, protection of personal information attracts the public's attention widely. This thesis attaches great importance to the personal information infringement and its form which are caused by national and non-national institution within administrative law on the basis of the definition for the concept of personal information. Thus we discovered that there are some problems existing in Administrative Protection for Personal Information and gives the solution for improving the relevant systems of personal information.This thesis falls into three parts:introduction, main body and conclusion. In the first part, the author analyses the denotation of personal information right and the theoretical framework of Administrative Protection for Personal Information on the basis of legal principle and constitution. In the second part, author introduces the current situation of Administrative Law Protection for Personal Information, then gives conclusion of the two types of main subjects which are involved in Administrative Protection for Personal Information. At last, the thesis illustrated the existed problems in Administrative Law Protection for Personal Information. In the third part, according to the comparative study of two kinds of typical legislation pattern in European Union and the America, the author firstly by putting forward the consistent legislation pattern for personal information protection, then by emphasizing the significance of legislative basic pinciples to the legislation for personal information protection and finally by giving some suggestions to better relevant system of Administrative Protection for Personal Information, which included improving the information disclosure system, establishing the personal information processing permitting system, establishing penalty system for personal information processing and verdict system for personal information processing.
