Securities brokerage legal property is the foundation to arrange investors and securities brokers. but there is a lot of controversy on this point whether educational circles or judicial circles. I think the securities brokerage is a series of legal acts by analysis bill-broking business compensively. This series of legal acts contain a series of different properties of the contract, therefore, the securities brokerage don't contain a single contract. In the different stages of the securities brokerage, the property must have different understanding. Investors and stock brokers'disputes can be quickly solved after difining the property of the securities brokerage contract.Therefore, I will study legal property of the securities brokerage in four chapters in my paper.the first chapter:" Outline of the Securities brokerage ". I first analysis concepts related Broker and concepts related Securities brokerage I sum up various concepts on securities brokers.The second chapter:"The controversy over the legal property of Securities brokers and the reasons".I introduct The controversy over the legal property of Securities brokers and the reasons, and emphasize the difference and disadvantages about the three main points.at the same time,I think the causes of conflict lies in basic theories concerning agency system, agency operations standard differences in the two legal system.The third chapter:"Analyze the legal property of securities brokers from the activities"from the whole process the securities brokerage,we can know the securities brokerage includes four aspects:Account commissioned,authorized transactions,the bid clssing,clearing and settlement.The securities brokerage include a set of contact of the different properties: contract of mandate,contract of securities managed,Agency bargain,Contract for settlement.Chapter 4:"defining clearly powers and responsibilities to brokers in the party ".On the base of defining property of the securities brokerage,I analysis the contradiction between the investors and the securities brokers.I advise to mend the "securities act".In the end,I define the rights and obligations between the investors and the securities brokers.
