On Education Administrative Disputes And The Legal Remedy System

Recently, education disputes have occurred continuously and many scholars have done many researches on this topic. I burrowed into reference books for research data and found that many scholars'researches on education disputes and legal aid system were not enough, and at the present stage, education administrative disputes were not to solve effectively. Accordingly, the foundation of paper is on that education administrative disputes are divided, and examines status in China and summaries defects on legal aid system. In addition, the paper focuses on referential and fine experience from abroad and puts forward a set of legal aid system which is to fit fundamental realities of the country.The purpose of the paper is to understand thoroughly on education administrative disputes and legal aid system. Whether education administrative disputes can be solved properly would influence educational cause greatly. Therefore, constructing reasonable legal aid system and resolving education administrative disputes will promote the development of education law and realize rejuvenating strategy.With over 30,000 words, this paper is composed of five parts. The major contents are as follows:The first part:collecting typical cases in recent years to raise an issue on education administrative disputes. The second part:with the education administrative disputes related problems. Firstly, education disputes are divided into education administrative disputes, education of civil disputes, education criminal disputes. Secondly, I declare these disputes'features and distinguish them. Finally, I divide education administrative disputes into different types according to different criteria. The third part:firstly it illustrates the current situation of resolving education administrative disputes, then points out their defects and deficiencies. The fourth part: it analyzes relief system of the common law system and continental law system, listening examples of measures taken by U.S, Britain and Canada, etc. They will help us for reference and transplantation. The fifth part:consideration of perfecting Chinese law aid system to education. I improve education appeal system, education administrative reconsideration system, education administrative litigation system and clear the relationship between them. Finally, I built a new relief system-education arbitration system to better solve education administrative disputes.
