Celebrity endorsement for false advertising is of great social harm to damage the interests of consumers, disrupt the market order and destroy the credit environment, resulting in serious negative social impacts. False advertising is labeled as advertising but it is fraud, bad faith conduct and violations. False advertising is its open nature of fraud of and does serious harm to today's society, causing a bad impact. Celebrities who have endorsement for false advertising causing harm to consumers, have an inescapable responsibility. Celebrity should know whether the product is eligible for review before endorsement for advertising, which is called "prudent obligations."Because celebrity endorsement for false ad is far greater than the general effect of false advertising, and the celebrities in the endorsement process gained huge endorsement fees, and celebrities engaging in false advertising can be addition to the compensation-related losses, they should got punitive damages.The legal relationship is the basic concept of law, and rights and obligations are two parts of the legal relations. If there are no obligations, there are no rights. In the perspective of welfare economics, the effectiveness of tort law is related to personal well-being. Tort Liability affects the welfare of perpetrators, which is created for potential incentive factors, prompting them to act in enhanced attention. Then adjust the individual behavior in order to reduce the occurrence of damage, and to reduce the possibility of their damages.The paper is comprised of four parts.The first part is about the situation of study on false advertising spoken by celebrities. This part defines the keywords of false advertising spoken by celebrities, and starts from the existing theoretical analysis of tort, celebrities engaging in false advertising should bear the general tort liability. It's theoretical basis for the article to define the right keywords and current research in this part..In the second part, the economic analysis of false advertising spoken by celebrities is studied. This part use the economic analysis method, start digging the deep-seated reasons for false advertising spoken by celebrities, the purpose is finding theoretical basis to fundamentally regulate false advertising spoken by celebrities.The third part analyzes the extra-territorial model study on the false advertising spoken by celebrities. This section research the legal situation of Taiwan, Japan, Thailand, Germany, the United States and South Korea, in order to sort out and study the successful experience for reference and methods.The fourth part is devoted to the suggestions on the regulation of false advertising spoken by celebrities. This part is comprised of two parts. The first part is legal regulation of false advertising spoken by celebrities from the perspective of the legislative and judicial; The other part is legal regulation of false advertising spoken by celebrities from the perspective of the legal enforcement.
