Legislative Systemization Research On International Labor Standard

ABSTRACT:With the economic globalization, the issue of labor standards is not the problem of a single country any more. It is getting more and more important and becoming the focus of governments all over the world in international trade. Issue of labor standards are in close contact with international trade, so this issue has also become a tough bifurcation in the new round multilateral trade negotiation between developed countries and developing countries. International labor rights have been infracted seriously during the process of competing between developed countries and developing countries. Because of there was not exist binding system so, International labor standards can not be implemented, which damaged the stable international trade order and environment. This article based on this background, applying the research method of systematic analysis, comparative analysis, factual evidence analysis, historical analysis to demonstrate the issue of International labor standards and International labor rights. I want to establish a complete and binding international labor standard system to explore the ways that the problem of International labor standards in international trade.The paper consists of three parts:introduction, body and conclusion. In the introduction part, the author expounds the following questions:the general background, the significance of research, means of research. In the body part, the paper mainly concentrates the basic theoretic research of international labor standards. Every country strives to speed up economic development in international trade. The economic development of developing countries is very rapidly that made developed countries so worried. Developed countries exploit International labor standards to limit developing countries. In order to establish the international labor standards system, the paper list two international trade cases between America and China, the author reviews the revolution of the trade-labor standards in the framework of WTO and expounds the differences between developed countries and developing countries from economic, politics to law. In this situation, establishing a system to relieve the tension between developed countries and developing countries is getting more and more important. What is more, the paper expounds the value of international labor standards system from economic, human rights to social justice and discuss the real obstacle that the system of international labor standards to face. For example, how to make international labor standards have universality, what is the most proper mode to establish the system. At last, the author studies the possible system construction of labor standards issue within the framework of WTO. Based on the successful establishment experiences of TRIPs, the author try to establish the TRLSs using framework of WTO. The paper expounds the object and purpose, guiding principles, legal basis, main content and settlement of disputes of the system in order to construct a binding and systematic system, increasing the international labor standards and protecting the international labor rights, urging the smooth development of international trade.In conclusion the author presents a very concentrated and compact summary of the paper.
