The Realization Of Corporate Social Responsibility In The Perspective Of Law

In the traditional business concepts and some related legal cogitations, the only target of an enterprise would merely be "profit-maximizing", namely enterprises do not have to carry out social responsibilities. However, social problems caused by the producing and management activities which are executed by enterprises have become increasingly more serious with rapid developments of the society and economy, and in such situations modern philosophy of Corporate Social Responsibility (CSR) which requires enterprises should fulfill social responsibilities while they are striving for "profit-maximization". Although, since CSR appears, debates surrounding it have never stopped, in my opinion yet, CSR has a solid theoretical foundation and significant social values, so its legitimacy is absolutely unquestionable, especially confronting with such backgrounds that social problems occur frequently in China now and also conspicuous gap between riches and poor emerges, researches on CSR and its realization are undoubtedly important for the sustainable development of China as well as constructing a socialist harmonious society.The CSR is a comprehensive subject, relevant researches can be carried on in perspectives of law, management, sociology, ethics and many other disciplines. In this article, the author specially conducts a research on CSR in the view of law which deems the nature and the realization of CSR as two emphases. At the begining, the author put out a brief description on the origin of modern philosophy of CSR. Hereafter, by describing the nature of CSR accurately according to some correlative analyses, the author makes great efforts to provide the theoretical basis for the realization of CSR ruled by law. Subsequently, the author demonstrates legitimacy of CSR in the light of analyzing the theoretical foundation and the practical significance of CSR. Finally, the author analyzes relevant practical experiences abroad and also the status of implementation of CSR in china which may bring us some inspirations, on this basis, the power sources of realization of CSR are explained in this article; and then the author discusses the necessity of the selection that we should realize CSR in the legal method; afterwards, basic principles that every relevant participant in the course of realization of CSR must abide by are also listed; and then the author discusses some remaining deficiencies as well as future perfection of the legal system of CSR in China. In the end, due to foregoing arguments, the author roughly describes the preliminary realization mechanism for CSR surrounding the fulfillments of legal obligations so that to make for figuring out some relative issues.
