On The Social Obligations Of Land Rights Holder

There are a large number of social obligations of land rights holder outside the civil law. But no one has studied on the common nature and characteristics of these obligations. Research on these obligations of land rights holder contributes to clearing the purpose of social obligations, protecting the social and public interests, improving legislation of social obligations.This paper is composed of three parts including the foreword, the body and the conclusion.The foreword gives a brief introduction of the topic's background in the first place. Thereafter it sums up and analyzes the review of the study on the relative issues of our current research, and evaluates the review as well. Finally, this part introduces briefly the content, the thought of demonstration and the innovation.There are four parts in the body.The first part clears that the land rights holder is the subject of social obligations, including land owners, land-use rights holder and other land rights holder.The second part introduces the history of land rights holder's obligations in different historical periods. In feudal society, the land obligations merged the economic and political obligations. In the 19th century, the legislation established the principle of absolute ownership. Since then, the socialization of ownership trends had emerged, it claimed that the land owner obligated to the society.The third part analyses the reasons of the social obligations and the theoretical basis. The land use usually influences other rights holder and the social and public interests, so it should regulate land rights holders' land-use behaviors.The fourth part is about the types of social obligations. The social obligations can be divided into three types, the limiting rights obligations, rational use of land obligations and obligations of the special sacrifices. Each type of social obligations needs to be further improved to protect the social and public interest, the paper proposes several improvements of social obligations.The conclusion part highlights the significance and accomplishment of the thesis.
