Applicability Study Of The Disposition Right Of Colleges And Universities On Expulsion From Academic Status

The fundamental purpose of education is educating people, therefore, disposition is just a means. To correctly understand and apply the disposition right of expulsion from academic status by law, management in colleges and universities should focus on education which seems like a starting point as well as the ultimate goal. People should implement the law's respect and care for in the management work.The author exerted theories of jurisprudence, administrative law, utilizing the methodologies of documentary research, comparative analysis and case study, drawing on the relatively mature foreign experience to preliminarily discussed the legal nature and the application of the college disposition right of expulsion from academic status.This paper consists of three parts. In the first part, the author started her discourse with the connotation of the college disposition right of expulsion from academic status and analyzed its legal principle basis,law and discipline origins and its legal attribute. In the second part, the author analyzed the main problems of the current college disposition right of expulsion from academic status, including the lack of rule of law concept, far-reaching "special power relationship theory", legislative defects, procedural blemish, relief defects etc. In the third part, the author gave some thoughts on the legal principle of establishment to improve the disposition right of colleges and universities on expulsion from academic status, its legislative perfection, procedure consummation and development of infringement remedy.
