The Research On The Freedom Of Press Under Chinese Socialist Rule Of Law

The right of freedom of press is based on the freedom of expression and publication, which appeared after the capitalism of political and economic developments. It plays an important role in the democratic country, and it is protected by different forms in various countries. Freedom of press has not been identified in our constitution and laws, but it should be intended in them. In practice, the freedom of press is regarded as the extension of freedom of expression and publication in our country, and it has been protected as a customary right. This leads to two contradictory situations in our freedom of the press: the one is the lack of protection on our freedom of the press, so it can not be effectively achieved; the other is the increasing cases of press violations, which result in the conflict between freedom of the press and the other rights. The essential reason on this phenomenon is that the freedoom of press has not been highly regulated by law in our country, and the related laws and regulation are not sound. This research respects to build and improve the socialist legal, combining with the comparative analysis of legal protection on the freedom of press between Western and Chinese. In this paper, we study the protection and restrictions about the freedom of press in order to promote rule of law on the press regulation.
