Research On Hearing Process In The Institution Of The Administrative Regulatory Documents

Administrative regulatory documents become more and more as the expansion of executive but a lot of produce,which can make up for the official Act and social stability,but because of their lack of democratic and scientific bring some negative effects to society.Hearing system,as an important system for administrative law an civilian's participation in administration,which can solve the problem of lack of democracy and science,and gradually cause attention of many countries and quickly applied.The promulgation of administrative punishment law in 1996 firstly introduced the hearing system in our administrative law area.Then the application of hearing system gradually expanded from the area of specific administrative to the area of abstract administrative activities.In both of the "Legislation Law" and "regulations establish procedures Regulations" consist of the provisions of the hearing system.But the hearing system is not satisfactory for our practice,or even a mere formality. In the formulation of the vast majority of abstract administrative acts of administrative regulatory documents,the hearing system is seriously lacked,which make the function of the system can not play and it is also difficult to fully reflect the value of their content. So,under the frame of law,the thesis begins from the general theory of hearing system,then research into the process,at last wish to find a better to build our own hearing system of institution administrative regulatory documents.This thesis include four parts:The first part gives a brief introduction of the general Principal of the hearing system in the institution of the administrative rules.It analyses the definition of the administrative hearing process,the definition the hearing system in administrative regulatory documents.It also probes in to the jurisprudential basis of hearing system in institution of administrative regulatory documents.The second part mainly analyses the status of international and inner side perspective of the hearing system in institution of administrative,and the law making in china about the hearing system in institution of administrative regulatory documentsThe third part related the problem in the hearing process in China and the reasons for these problems.Aiming at the problems in hearing scope, hearing participants,the validity of the notes and so on in order to find the way to solve it.The second part mainly point out my own idea of the proposal of building and improving our regulatory documents in the hearing system development on the basis of the first three chapters,which includes the general theory and the specific action plan.
