Since the reform and opening up,due to the continuous improvement of socialist democratic politics and the construction of the rule of law,the citizens’ political consciousness has gradually awakened,and the public’s desire to participate in administrative decision-making has become increasingly strong.From the perspective of the international environment,the degree of public participation in administrative decision-making has also become the cornerstone of modern democracy in various countries.In order to further ensure that citizens can better realize their right to participate in politics,the high degree of political support provides a strong backing for the rapid development of the public participation legal system.In the process of administrative decision-making,the state has made numerous laws and regulations on public participation,and many laws and regulations have embedded public participation in the procedures.However,due to China’s traditional political,cultural,economic,and the influence of various factors,such as government decision-making concept in the practice of administrative decision-making,the law established the system of public participation in administrative decision-making procedures have been shelved,the effect of public participation in the process of administrative decision-making,there are a lot of problems.Therefore,a comprehensive,in-depth and detailed study of this system,so as to solve the problems of public participation in administrative decision-making in our country,and to achieve the democratization of administrative decision-making,scientific,and the rule of law,has become a very important research topic.Full text is divided into four parts,the first part of the basic concept of public participation in administrative decision-making process was carried out to clarify,studied the theoretical basis for public participation in administrative decision-making procedures,including the theory of governance and good governance,people’s sovereignty theory,theory of due process,and analyzes the necessity and significance of public participation in the administrative decision-making program.The second part studies the legal system of public participation in the administrative decision-making process of the United States and Canada.In the third part,through the comprehensive analysis of the relevant legal norms of public participation in China’s administrative decision-making process,the author puts forward three problems existing in the current public participation in China’sadministrative decision-making process.The fourth part,aiming at the existing problems of this system in our country,puts forward Suggestions to improve the public participation in the administrative decision-making process.These countermeasures and Suggestions will be of great value to improve the quality of the government’s administrative decision-making and make the public participation truly become an effective form of citizen participation in politics. |
