China has always maintained the basic trend of economic development and long-term trend for the better. But we should face of the negative impact on China's economy under international financial crisis. We have to be vigilant and reflect on the economic crisis shift to social crisis due to unemployment. Migrant workers suffered heavy losses because of themselves and unsound social security system.The issue of migrant workers interferes with the process of industrialization and urbanization in China. It has attracted attention from people of all walks of life. There are some obstacles should be overcome urgently in the protection of migrant workers such as severe and complicated economic environment, lack of preparation, poor implementation, lack of government protection functions of the existing institutions and organizations, the factors can not fully perform their duties. It is the time to adopt effective measures to solve the issue of migrant workers completely.This article selects part of Shanghai migrant workers'protection as object of research. Propose a solution in group disputes, high crime rate and the outstanding problem of wage arrears for migrant workers in 2008. It mainly divided into three parts. The first part is to mainly analyze 2008 relevant statistical data in order to demonstrate legal issues restricting migrant workers against the background of the financial crisis. The second part is to study why the migrant workers could not enjoy equal legal status and legal rights. Put forward within China's legal framework, give migrant workers as soon as possible a clear concept of legal definition, explore the system root. The third part is to further analyze the plan of protection of migrant workers under financial crisis.
