Study On The Legal Issues Of Rural Social Welfare In China

Rural social welfare is a strong guarantee to enhance the literacy and wealth level for rural residents. Although as the "maximum aspect" of China's social security system, the development of the rural social welfare is stalled. It is because the social welfare concept in China is on a vague position, as well as the absence of institutional arrangements under the Urban-rural dual system. As China's "new socialist countryside" strategy has been promoted, rural social welfare becomes the hottest focus of the "new countryside" construction. Therefore, the content and extension of rural social welfare should be clarified as soon as possible, and the accurate position of it should be made clear. Besides, we the existing legal problems of the rural benefit system should be paid attention to, and the construction and improvement of the specific content of the rural social welfare system should be stepped up to. In this paper, the author will investigate the relevant issues of China's rural social welfare in five parts, expecting an effective way to build the Chinese rural social welfare systems can be discovered through the theoretical puzzle.China's rural social welfare system is elaborated in the first part. In this section, the definition of the social welfare as well as the content and extension of China's rural social welfare is investigated to clarify the foundation of this paper, which is built on the correct and development-oriented concept of social welfare in the legal sense. And then by means of researching in the history and the significance of our country's rural social welfare, the importance of this system to our social security institutions is traced to its source.The comparison and implications of different rural social welfare systems on board are analyzed in the second part. In this section, three different kinds of the social welfare system are respectively studied, the United Kingdom and Sweden are chosen as the representative of the big welfare country, the America and Japan as the representative of the special welfare country, and India which has more similarity to us to stands for the developed country. Under this kind of the technical research, the important and material enlightenment is coming out.The present situation and problems of the rural social welfare in China are analyzed in part three. Through the study of the present situation, the intricate problems are tolled from the condition. It is not only the lack of understanding from our government and society, the distemperedness of the rural social welfare system, but also the absence of our welfare system.Part four is the macroscopic supposition of our country's social welfare system. This section focuses on distribution of our country's rural social welfare system theories at the macro level, including the establishing of elementary object, the definition of the localization of institution and the confirmation of the fundamental principle. It hopes that there will be a good foundation to the construction of the idiographic system later.Part five, the discussion of specific mechanisms about our country's social welfare system. This part is the last section, and it is also the most important one. By means of careful study and tentative construction about the security mechanism of funds, the direction of the main construction of the system, the security mechanism and the supervision mechanism, the specific constitution of our country's rural social welfare system are sketched out. And the opinions of the author are stated and demonstrated in the hope of giving inspiration to others.
