Huai River Pollution Control Study Of Legal Problems

Watershed management is based on river basins as the unit of the Water Resources Management. Implementation of watershed management of water resources in many countries over a long period of exploration and the final approach taken, and has become a common trend, for the protection of water resources play an important role. At present, China has enacted a number of river basin and watershed management-related legislation, the establishment of the Yangtze River, Yellow River, Huaihe River, Pearl River, Taihu Lake basin management at different levels with seven on the river basin water resources protection played a role. However, watershed protection of water resources and effective legal system does not create, gaps in existing regulations point management system that is not watershed management organizations, environmental law enforcement and regional coordination of interests Bu Gou, makes the lack of legal protection of watershed protection of water resources to run weak. Therefore, establishing a sound legal system to protect the river basin, for the protection of the law, through a full range of system specification to overcome the drawbacks of the existing system has been a priority.This paper aims to improve the Huaihe River Basin management system for order management system for the HRB to provide reference for the Improvement of the main set from several aspects.The first part of the Huaihe River and governance problems, summing up years of successes and failures in the Huaihe River management, pointed out that China's current system of Huaihe River Basin to protect the existing problems, mainly the imperfections in the legal pollution control legislation, river basin management institutions do not function clear and public participation in the system is not complete and so on.The second part is the protection by introducing the river basin to get better experience of countries, including Britain, the United States, other countries to learn from the advanced experience of watershed protection systems. From the characteristics of water resources in China and China's realities, this paper discusses the transformation and development of environmental law, expounded China's watershed protection system reform.The third part of the protection legislation in the Huaihe River Basin and analysis of defects based on the sound system made the relevant proposals. First, complete with the concept of sustainable development, watershed legislation, establishing a multi-level legal system to protect water resources, to further clarify the legal implementation of the watershed control system. Second, institutional reform, watershed management, and enhance the functions of river basin management institutions, establish the overall awareness of watershed, watershed management and regional coordination of management, the establishment of coordination mechanisms of various interests within the watershed. Third, a clear government responsibility, and regulate government conduct. Fourth, protection of environmental rights and interests of citizens to establish civic environmental claims, and improving public participation and environmental dispute resolution mechanism.
