Studies On The Socialism Harmonious Society's Migrant Workers Labour Protection Certain Legal Issues

Recently, the infringement on migrant workers'rights and interests is often reported in media and it has resulted in many of disputes and conflicts in the society. Some of these workers made their responses to the infringement by means of primitive and miserable suicide. The recent tragedy has drawn our attention to the following issues concerning migrant workers: How to safeguard the labor rights and interests? How to reform the protection mechanism? Why they ended their lives in such an extremely radical way? How to assist them to rationally deal with the infringement by law?This article reference in the process of writing the latest issued by the National Bureau of Statistics,"2009 Monitoring Report of migrant workers", combined with the process of migrant workers in the workers and the actual situation encountered in the relevant laws and regulations of China.The article has analyzed the problems encountered by migrant workers in respect of backgrounds, regulations and rules in light of the Labor Law and other relevant law. Thereafter, some suggestions are put forward to protecting labor rights and interests of migrant workers on the ground of legislation, administration and jurisdiction. Furthermore, I hope to contribute my pygmy effort to safeguard the rights and interests of migrant workers.
