Medical service is one of the hot issues highly concerned, also one of the outstanding problems strongly reacted. The medical system is related to the vital interests of people, he sustained and healthy development of medical system in China, we must seize the opportunity to accelerate development, but the medical system of china is not satisfactory now. Based on this situation, the article analyzes and researches the legal mechanism of government responsibilities in the medical system of china from the perspective of Administrative Law to seek methods to solve these problems.The thesis begins with the basic theory the legal mechanism of government responsibilities in the medical system of china, following in-depth analysis on a few outstanding legal issues of the legal mechanism of government responsibilities in the medical system of china in this stage:laws and regulations fall short; the law Positioning of medical institutions and administrational departments of is not clear; medical market is chaotic and the supervision of Government is inadequate; the allocation of health resources is irrational. In order to resolve theses issues, the thesis studies on the legal mechanism of government responsibilities in the medical system of the United States, Britain, Germany and Singapore, then through a comparative analysis to achieve some enlightenment, that is to strengthen the responsibilities of government for rational use of health resources; enrich the laws and regulations of the medical system;improve the medical security system.Finally, with the national conditions of china, the thesis analyzes the value of improving the legal mechanism of government responsibilities in the medical system of china from the perspective of human rights, fairness and efficiency and building a harmonious society, then gives some legal advice about law enforcement, government functions, medical protection and resource allocation.
