"The Labor Contract Law of the People's Republic of China"started to implement on January 1, 2008. Of this law the open-ended labour contract system has attracted most people's attention and caused people's dispute. The most basic reason that open-ended labor contract has received so much high attention lies in the close relationship among the workers; the enterprise as well as other counterparts. It has some influence on their related benefits.Most people think that open-ended labour contract only has advantages on the workers and has harmed employers'benefits, therefore, many employers have regarded it as the disasters and has carried on fierce criticize to it. In fact, open-ended labour contract's implementation has changed the traditional short-term employment pattern that is not favor of the development, therefore, in the long run; its implementation is a win-win measure no matter for the workers or for the employers. It will not only enhance the worker's identity and the sense of trust to the employers, but also promote the enterprise's making great strides. Because of all kinds of misunderstanding and suspicion on open-ended labor contract, therefore, this article will clarify some puzzles from the aspects of the open-ended labor contract's definition, characteristic and conduct more thorough research and analysis.
