Open-ended labor contracts have no satisfactory effect in practice,the reason is that legislative technology still has room for improvement,and the implementation of the law did not start from the basic national conditions of our country.On the system idea,it is regarded as welfare benefits for workers,imperfect dismissal system and "one size fits all" practice in judicial practice,which results in employers' refusal to sign open-ended labor contracts.In order to effectively promote the application of the system of open-ended labor contracts and better establish stable and harmonious labor relations,we should summarize the experience and find out the breakthrough,so as to improve the legislative ideas and supporting systems.Based on the analysis of the real case and the focus of the dispute,this paper discusses the system of open-ended labor contract.This paper focuses on the analysis of the implementation status and legislative defects of the system of open-ended labor contracts,and through a comparison of open-ended labor contracts,including those of Britain,the United States,France and Germany,we will gain enlightenment on improving Chinese relevant legal systems.Finally,on this basis,from the application of open-ended labor contracts,dismissal protection and other related legal measures,put forward Suggestions to improve Chinese open-ended labor contract system.
