The Authority Analysis And Regulations To The Professional Associations

With the development of market economy and the reform of the government continuing in-depth, the professional associations not only maintaining the interests and the development of itself, but also assuming more and more public management functions. This phenomenon conforms to the tendency of "Administrative Reform" that arisen in most of the country in the world. To note that, the power of the professional associations has expanded with the increase of the functions, but the supervision system was not founded in sharp contract. The absence of the supervision system cause that the supervise to the professional associations un-effectible when they're using their power, and more than that can not protect the interests of the counterparty adequately. Thus, to discuss the power and the supervision system of the professional associations has an important meaning in theory and practice.Except the introduction and conclusion, this paper is divided into four parts as follows:In the introduction section, which briefly described the research background, research methods, research purposes and so on;The first part is an overview of the professional associations. This section discusses the concept, forms and characteristics of the professional associations. And analyses the reason of the revival of the professional associations. Besides, describes the current status of the professional associations in our country.In the second part, this paper firstly analyses the construction of the power of the professional associations from the origin of the power aspect. There're three kinds of power: the power combed from formation, law authorized and administrator entrusted. In this case, the paper tries to sum up the causes of these problems which come from the power of the professional associations using in action.In the third section, the paper introduced the supervision system of the professional associations in the other countries. By introducing the professional associations and the related institute of the USA, France and German, then propose the experience and aspects which should absorb or pay attention to when building the system of our country.In the fourth part, this paper discussed the construction mode of the supervision system of the professional associations in our country. The system mode can conduct in two aspects: the first aspect is the internal regulation which contains constitution regulation drafting, the regulatory of the organization and the enforcement procedures of regulation; the second is the external regulation which is made up of the administrator, legislation and judicial regulation. Thus try to achieve a perfect results through internal and external integration.In the conclusion section, this paper emphasizes the important of the supervisor of the powers of the professional associations again. The professional associations can play an active role in the society approach to building a perfect supervisor system.
