The Research On Administrative Guidance Procedure Construction

Administrative guidance is a non-compulsory and innovative administration management system. Adopting the administrative guidance in marketing economic countries, many administrative subjects can mobilize administrative counterparts to be voluntarily collaborative to government management, so as to make up the gaps for law and reduce administrative cost. With the establishment of socialist market-oriented economy system, in our country, administrative guidance began to take effect in economic and social management fields, but it maintains in a low level both in the implementation method and effect of administrative instruction. As an important means to build a service-oriented government and to advance the democratic administration, the non-compulsory and flexible management mode, administrative guidance, which can play its tremendous role fully only standby the administrative procedure to regulate and protect. Recently, scholars have made abundant study for the administrative guidance, but research on administrative guidance procedure was deficiency. With an insufficiency theory back-up support, it restricted administration instruction practice and procedure construction. Therefore, it's essential to strengthen and improve administration guidance procedure in our country.The paper introduces the concept of administrative guidance and administrative procedure regulation firstly, putting forward that the construction of administrative guidance program is inevitable. Then making an empirical study and comment on administrative guidance procedure and some representative procedure system in our country. Secondly, by the support of these empirical cases mentioned above, the article is to discuss a few problems existing in administrative guidance procedure in our country at present, such as the drawbacks in notion, theory, law, Setting-up and implementation of administrative guidance procedure are all frail, moreover, the supervision and redressment are not effective, and to analyze the related causes. Then to explore and summarize the advanced experience of administrative guidance procedure construction in foreign countries in a comparison research method. Finally, based on the foreign advanced experiences, the author put forward the suggestions: Firstly, to update the notion of administrative procedure; Secondly, to advance the theory of administrative guidance procedure; Thirdly, to set up core principles of administrative guidance procedure construction; Fourth, to construct the legal system of administrative guidance procedure; Fifth, to establish the system of administrative guidance procedure; Sixth, to complete the supervision and redressment system, So as to make the administrative guidance more democratic and scientific.
