Since the Industrial revolution, human society made global warming while consuming too much fuel to promote the development of economic and society. Climate change as a global crisis had already gain world wide concentration. It is necessary to start wide range global cooperation to control climate change, and the establishment of international law mechanism of climate change is the base to open wide range international cooperation. But some flaws exist in current mechanism, made international cooperation could not develop.Firstly the thesis analysis the frame of the international law mechanism of climate change, introducing the birth, development, influence and character of both UNFCCC and Kyoto Protocol, analysis its develop mode, inner market mechanism and the obligation implementation situation by some countries. The situation isn't optimistic, this thesis think that there are big flaws in current mechanism that they exteriorly shows in mechanism design, but the inner reasons are the interest conflicts between different countries, the gap between developed countries and developing countries and the flaws in compliance mechanism. It is because of these flaws that cause the failure of Copenhagen and the hard condition of Kyoto Protocol. The financial crisis changed current mechanism sharply, made the international law mechanism of climate change much more difficult to develop and hard to predict its future.Climate Change doesn't wait, mending the international law mechanism of climate change is essential. The thesis thinks that the mending action should follow the basic principles of climate change, mending the flaws in mechanism design, international cooperation mechanism and international environmental enforcement mechanism. Developed countries and developing countries should start wide range international carbon trade, searching for the same interest point in market mechanism and made it the starting point for international cooperation. The strict international environmental enforcement mechanism is the system security to fulfill the obligations set by the Kyoto Protocol. The failure of Copenhagen should not happen again, the international law mechanism of climate change could promote only in constant promoting. And only if current mechanism implanted strict enforcement mechanism and start wide range cooperation that it could achieve its aim——control climate change, protect the earth and protect the human being...
