State law, the civil society in the habit of people in the specification of rights and obligations to maintain the ethical conduct of human society and running order and maintain the normal operation of society and so played a significant role. Modern China's land sale and inheritance of behavior, the functions state law is relatively limited, non-governmental transactions and inheritance of land mainly in the context of national law as the basis of local civil habits conducted. On land sales, inheritance customs, said basically the same theme throughout, but the concept preached by the use of certain regional characteristics, the spatial and temporal differences. In this paper, Qing and early Republic of China conducted a civil investigation report used as the basic data, based on a modern Chinese society over the land sale and inheritance of habit, tried to explore the unity of political power and cultural traditions of various regions under the civil habits of objective differences nature, and thus the historical depth of national law and anchored to the land sale and inheritance of the civil habits of carding and analysis.This article has six parts. The first part is an introduction, introduces the topics of purpose, significance, status and reference this article, "civil habits survey recorded" in the background. The second part introduces the contents and characteristics of civil habits. Land for Sale in the third party; 6. Living selling must sell, looking for price, redemption; 7. breach of contract processing. Part V focuses on modern Chinese civil customary land inheritance. In this section, the first of the modern civil habits of the family tradition of inheritance was summarized, and then the land inherited from the various schools be divided in two aspects of women's rights and discusses the habits of modern China inherited the same land, similarities. Conclusion part discusses the civil habits in modern China and the succession of land transactions and how the general features of the civil practices in today's society should be to maximize the positive role of its content.
