On The Updating Of Law Enforcement Idea Of Public Security

As one of the state administrative organs related to the masses most closely, the quality and level of the law enforcement behavior by public security organs not only will directly influence the fundamental interests of the great masses, but also will concern the images of the Party and the Government. Law enforcement idea is the precursor of law enforcement behavior, and the type of law enforcement idea will lead to such type of law enforcement behavior. For a long time, the public security of our country has been influenced by many factors from such as history and reality, etc. and the law enforcement behavior conducted under the guidance of some traditional and outdated law enforcement idea has not only damaged the images of the Party and the Government, but also has made many lawful rights of the masses not be safeguarded well, which finally has decreased the public trust on law enforcement of public security, reduced the satisfaction of the masses and even will lead to many social problems. Therefore, in order to adapt to the overall situation needed by the development of modern Chinese society under the rule of law and the construction of a socialist harmonious society, the public security has to update their traditional law enforcement idea and establish a modern law enforcement idea of public security meeting the requirements from the development of a modern China under the rule of law. The thesis is conducted based on research towards several issues concerning the updating of law enforcement idea of the public security, and the author's own proposals and views are also put forward here.The thesis is divided into four parts as below:Part-1 is about the overview of law enforcement idea of the public security. Proceeding from law enforcement of the public security, the connotation of the law enforcement idea of public security is illustrated, indicating that it is a kind of high-level law enforcement awareness, the ideological understanding, mental attitude and value orientation of the subject of law enforcement from the public security towards a series of issues related to the public security such as the nature, responsibility, power, function, policy and strategy, etc. and the inner belief and concept towards the authority, function and effect of the law and the law implementation that are held. And from four aspects, the significance of law enforcement idea of the public security is dissected. Part-2 is about the traditional law enforcement idea of the public security. In this part, the author summarizes various representations of the traditional law enforcement idea of the public security which are manifested as emphasizing public rights & neglecting private rights, emphasizing entities & neglecting procedures, emphasizing management & neglecting services, and emphasizing power & neglecting supervision. Further more, the four major factors leading to such kind of traditional and out-dated law enforcement idea are also analyzed deeply, respectively as the historical factor caused by the left over thought of feudal privilege, the social economic factor led by the interference from the planned economy, the reality factor brought by the attack from the legal instrumentalism and the direct factor led by the unclear role positioning of the public security.Part-3 is about the updating of the law enforcement idea of public security. Over the 30 years since the reform and opening-up, dramatic changes took place in all aspects in our country, such as the in-depth reform of the economic system, the great changes of social structure, the deep adjustment of the mix of social interests and the huge changes of ideological concepts. Under the new historical condition and social background, the pluralism and diversity have appeared in the following aspects such as the economic sector, the organization form, the mode of employment, the relationship between interests and the mode of distribution, which has brought a more changeable and complex social condition and law enforcement environment to be confronted with by the law enforcement work of the public security. For the purpose of adapting to the progressive steps of making China under the rule of law during the social transition period and the new requirements for the public security's work by the 17th National People's Congress, it should be made sure that the public security should update their traditional law enforcement idea. And meanwhile, a further discussion on the necessity of updating the law enforcement idea of public security is performed, which is pointed as the necessity of the historical development of the public security's work.Part-4 is about the establishing of the law enforcement idea of public security. The modern law enforcement idea of public security is mentioned directing at the traditional and up-dated law enforcement idea of public security, and is the name for the law enforcement ideology, concept, awareness and thought required by the contemporary rule of law and the construction of a harmonious socialist society that should be needed in the public security and the people's police. It concretely includes the following ideas such as supremacy of law, right-oriented, respecting and safeguarding human rights, valuing fairness, justice & efficiency, and harmonious law enforcement. In a close combination with the law enforcement work of the public security, the author makes clear the due meanings of the five law enforcement ideas of public security said above and puts forward the concrete methods to really set up the modern law enforcement idea of public security which are as below: Firstly, reform the current management system of the public security deeply and strictly control the entry passage; Secondly, improve the comprehensive quality of public security and police with all the efforts; Thirdly, enhance the legal supervision in combination with the law enforcement practice; Fourthly, perfect the logistic guarantee and enlarge the investment in law enforcement work of the public security.It will concern not only the vital interests of the great masses but also the transformation of the images of the Party and the Government, the progression of the process of making China under the rule of law and the construction of a harmonious society that whether the public security can really change their traditional law enforcement idea and truly set up a modern law enforcement idea suitable for the development of China under the rule of law. Considering that, the thesis is conducted on the base of research and consideration on several issues closely concerning the updating of law enforcement idea of the public security to be used for some kind of reference.
